LICENSED APPLICATION END USER LICENSE AGREEMENT

Apps made available through the App Store are licensed, not sold, to you. Your license to each App is subject to your prior acceptance of either this Licensed Application End User License Agreement (“Standard EULA”), or a custom end user license agreement between you and the Application Provider (“Custom EULA”), if one is provided. Your license to any Apple App under this Standard EULA or Custom EULA is granted by Apple, and your license to any Third Party App under this Standard EULA or Custom EULA is granted by the Application Provider of that Third Party App. Any App that is subject to this Standard EULA is referred to herein as the “Licensed Application.” The Application Provider or Apple as applicable (“Licensor”) reserves all rights in and to the Licensed Application not expressly granted to you under this Standard EULA.

a. Scope of License: Licensor grants to you a nontransferable license to use the Licensed Application on any Apple-branded products that you own or control and as permitted by the Usage Rules. The terms of this Standard EULA will govern any content, materials, or services accessible from or purchased within the Licensed Application as well as upgrades provided by Licensor that replace or supplement the original Licensed Application, unless such upgrade is accompanied by a Custom EULA. Except as provided in the Usage Rules, you may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time. You may not transfer, redistribute or sublicense the Licensed Application and, if you sell your Apple Device to a third party, you must remove the Licensed Application from the Apple Device before doing so. You may not copy (except as permitted by this license and the Usage Rules), reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application, any updates, or any part thereof (except as and only to the extent that any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by the licensing terms governing use of any open-sourced components included with the Licensed Application).

b. Consent to Use of Data: You agree that Licensor may collect and use technical data and related information—including but not limited to technical information about your device, system and application software, and peripherals—that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to the Licensed Application. Licensor may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide services or technologies to you.

c. Termination. This Standard EULA is effective until terminated by you or Licensor. Your rights under this Standard EULA will terminate automatically if you fail to comply with any of its terms.

d. External Services. The Licensed Application may enable access to Licensor’s and/or third-party services and websites (collectively and individually, "External Services"). You agree to use the External Services at your sole risk. Licensor is not responsible for examining or evaluating the content or accuracy of any third-party External Services, and shall not be liable for any such third-party External Services. Data displayed by any Licensed Application or External Service, including but not limited to financial, medical and location information, is for general informational purposes only and is not guaranteed by Licensor or its agents. You will not use the External Services in any manner that is inconsistent with the terms of this Standard EULA or that infringes the intellectual property rights of Licensor or any third party. You agree not to use the External Services to harass, abuse, stalk, threaten or defame any person or entity, and that Licensor is not responsible for any such use. External Services may not be available in all languages or in your Home Country, and may not be appropriate or available for use in any particular location. To the extent you choose to use such External Services, you are solely responsible for compliance with any applicable laws. Licensor reserves the right to change, suspend, remove, disable or impose access restrictions or limits on any External Services at any time without notice or liability to you.

e. NO WARRANTY: YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED APPLICATION AND ANY SERVICES PERFORMED OR PROVIDED BY THE LICENSED APPLICATION ARE PROVIDED "AS IS" AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND LICENSOR HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE LICENSED APPLICATION AND ANY SERVICES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NONINFRINGEMENT OF THIRD-PARTY RIGHTS. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY LICENSOR OR ITS AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SHOULD THE LICENSED APPLICATION OR SERVICES PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSION AND LIMITATIONS MAY NOT APPLY TO YOU.

f. Limitation of Liability. TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE LICENSED APPLICATION, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU. In no event shall Licensor’s total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of fifty dollars ($50.00). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

g. You may not use or otherwise export or re-export the Licensed Application except as authorized by United States law and the laws of the jurisdiction in which the Licensed Application was obtained. In particular, but without limitation, the Licensed Application may not be exported or re-exported (a) into any U.S.-embargoed countries or (b) to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List or Entity List. By using the Licensed Application, you represent and warrant that you are not located in any such country or on any such list. You also agree that you will not use these products for any purposes prohibited by United States law, including, without limitation, the development, design, manufacture, or production of nuclear, missile, or chemical or biological weapons.

h. The Licensed Application and related documentation are "Commercial Items", as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation", as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §227.7202-1 through 227.7202-4, as applicable, the Commercial Computer Software and Commercial Computer Software Documentation are being licensed to U.S. Government end users (a) only as Commercial Items and (b) with only those rights as are granted to all other end users pursuant to the terms and conditions herein. Unpublished-rights reserved under the copyright laws of the United States.

i. Except to the extent expressly provided in the following paragraph, this Agreement and the relationship between you and Apple shall be governed by the laws of the State of California, excluding its conflicts of law provisions. You and Apple agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Santa Clara, California, to resolve any dispute or claim arising from this Agreement. If (a) you are not a U.S. citizen; (b) you do not reside in the U.S.; (c) you are not accessing the Service from the U.S.; and (d) you are a citizen of one of the countries identified below, you hereby agree that any dispute or claim arising from this Agreement shall be governed by the applicable law set forth below, without regard to any conflict of law provisions, and you hereby irrevocably submit to the non-exclusive jurisdiction of the courts located in the state, province or country identified below whose law governs:

If you are a citizen of any European Union country or Switzerland, Norway or Iceland, the governing law and forum shall be the laws and courts of your usual place of residence.

Specifically excluded from application to this Agreement is that law known as the United Nations Convention on the International Sale of Goods.

By using Stylebuddy, you agree to the terms outlined in this Privacy Policy.

If you are wondering what happens to your files when you upload them, the answer is simple: We upload them securely, process them as you would expect, provide you with the results for download, then delete them shortly after. That’s all.

We don’t publish your files, we don’t share them with anyone unexpected and we don’t use them to improve our products, unless you explicitly send them to our team as feedback.

We keep usage statistics (without your files) and if you contact us e.g. by email, we use the personal data you provide for our reply. If you buy from us, we also keep data for purposes like bookkeeping and financial reports.

This Privacy Policy describes our practices with respect to Personal Information we collect from or about you when you use our website, applications, and services (collectively, “Services”). This Privacy Policy does not apply to content that we process on behalf of customers of our business offerings, such as our solution. Our use of that data is governed by our customer agreements covering access to and use of those offerings.

1. Personal information we collect

We may collect the following Personal Information directly from you:

  • Photographs via your camera or camera roll (with your direct permission), body measurements, body type, height, gender and other information provided by you when using the Services. We access only the specific images you choose to grant us access to using the mobile application; we do not collect or store your photo albums, even if you grant us access to them.
  • Account registration information: email, full name, and password
  • Onboarding questions: Gender, Age Group, Body Type, Skin Tone, About Summary
  • Optional Personal Information that can make the Services more personalized. This may include: profile picture, your location, gender category of clothing, clothing size, favorite colors, price preferences and other information.

We may also collect certain Personal Information automatically or based on your approval within the app:

  • Application usage information such as information about how you use and interact with the Services, including your preferred language, the date and time when you first installed the App and the date and time you last used it, your onboarding path (e.g. the source you found us from), certain geolocation data (if permitted on device level).
  • Data we receive from third parties – websites, services, and products when you interact with Social Features of our application.
  • Location- to show the weather and temperature of your specific city/locality you are in. You can opt out of this when you are prompted to share your location with us.

Personal Information we Receive Automatically From Your Use of the Services: When you visit, use, or interact with the Services, we receive the following information about your visit, use, or interactions (“Technical Information”):

  • Log Data: Information that your browser automatically sends when you use our Services. Log data includes your Internet Protocol address, browser type and settings, the date and time of your request, and how you interact with our website.
  • Usage Data: We may automatically collect information about your use of the Services, such as the types of content that you view or engage with, the features you use and the actions you take, as well as your time zone, country, the dates and times of access, user agent and version, type of computer or mobile device, and your computer connection.
  • Device Information: Includes name of the device, operating system, device identifiers, and browser you are using. Information collected may depend on the type of device you use and its settings.
  • Cookies: We use cookies to operate and administer our Services, and improve your experience. A “cookie” is a piece of information sent to your browser by a website you visit. You can set your browser to accept all cookies, to reject all cookies, or to notify you whenever a cookie is offered so that you can decide each time whether to accept it. However, refusing a cookie may in some cases preclude you from using, or negatively affect the display or function of, a website or certain areas or features of a website.
  • Analytics: We may use a variety of online analytics products that use cookies to help us analyze how users use our Services and enhance your experience when you use the Services.
  • Images: As part of the Stylebuddy.in product experience and solution, we ask users to upload images and add specific preferences to render the perfect output.

2. How we use personal information

We may use Personal Information for the following purposes:

  • To provide, administer, maintain and/or analyze the Services;
  • To improve our Services and conduct research;
  • To communicate with you;
  • To develop new programs and services;
  • To prevent fraud, criminal activity, or misuses of our Services, and to protect the security of our IT systems, architecture, and networks;
  • To carry out business transfers; and
  • To comply with legal obligations and legal process and to protect our rights, privacy, safety, or property, and/or that of our affiliates, you, or other third parties.
  • We dont store or access any type of images that are uploaded as part of any of our solutions.
  • No chat data is saved by us at any point. However, to provide users a better experience, we save the chat during chatting sessions when the user is using the platform. Upon exiting the platform, the chat data automatically gets deleted. No chat in the form of text, photos, video, etc. is saved by stylebuddy.in or any other user as such

Aggregated or De-Identified Information. We may aggregate or de-identify Personal Information so that it may no longer be used to identify you and use such information to analyze the effectiveness of our Services, to improve and add features to our Services, to conduct research and for other similar purposes. In addition, from time to time, we may analyze the general behavior and characteristics of users of our Services and share aggregated information like general user statistics with third parties, publish such aggregated information or make such aggregated information generally available. We may collect aggregated information through the Services, through cookies, and through other means described in this Privacy Policy. We will maintain and use de-identified information in anonymous or de-identified form and we will not attempt to reidentify the information, unless required by law.

As noted above, we may use Content you provide us to improve our Services, for example to train the models that power Stylebuddy.in.

2A. Virtual Coins / In-App Currency

We may offer virtual, in-app currency (“Coins”) that can be purchased with real money and used within the App for digital goods or services.

  • No Monetary Value
    Coins are not legal tender, have no cash value, and are not redeemable for money or any monetary equivalent.
  • License Only
    Coins are licensed, not sold, to you. You do not own any Coins.
  • Purchases
    Coins may be purchased through our authorized payment providers (e.g., Apple App Store, Google Play). All purchases are final and non-refundable, except where required by applicable law or platform policies.
  • Usage
    Coins may only be used within the App for designated features or services and cannot be used outside the App.
  • Non-Transferable
    Coins cannot be transferred, sold, gifted, or traded to other users or third parties.
  • Expiration (Optional – include only if true)
    Coins may expire after a specified period. Any expiration terms will be clearly communicated at the time of purchase.
  • Account Termination
    If your account is suspended or terminated, you may lose access to any remaining Coins without compensation.
  • Pricing Changes
    We reserve the right to modify pricing, exchange rates, or availability of Coins at any time.

2B. Payments and Refunds

  • All purchases of Coins are processed through third-party payment platforms.
  • Prices may include applicable taxes and fees as required by law.
  • Refunds are handled in accordance with the policies of the relevant app store or payment provider.
  • We do not provide refunds for unused Coins unless required by law.
  • You are responsible for reviewing your purchases before completing transactions.

2C. Transaction and Purchase Information

If you purchase Coins, we may collect information related to your transactions, such as:

  • Purchase amount
  • Date and time of transaction
  • Transaction ID
  • Platform (e.g., iOS, Android)

We do not collect or store full payment card details. Payments are processed by third-party providers.

2D. How We Use Information

We use transaction data to:

  • Process and manage purchases
  • Provide customer support
  • Detect fraud or abuse
  • Comply with legal obligations

2E. Fraud and Abuse

We reserve the right to suspend or terminate accounts and revoke Coins if we suspect fraudulent, abusive, or unlawful activity, including unauthorized payments or chargebacks.

3. Disclosure of personal information

In certain circumstances we may provide your Personal Information to third parties without further notice to you, unless required by the law:

  • Vendors and Service Providers: To assist us in meeting business operations needs and to perform certain services and functions, we may provide Personal Information to vendors and service providers, including providers of hosting services, cloud services, and other information technology services providers, email communication software, and web analytics services, among others. Pursuant to our instructions, these parties will access, process, or store Personal Information only in the course of performing their duties to us.
  • Business Transfers: If we are involved in strategic transactions, reorganization, bankruptcy, receivership, or transition of service to another provider (collectively, a “Transaction”), your Personal Information and other information may be disclosed in the diligence process with counterparties and others assisting with the Transaction and transferred to a successor or affiliate as part of that Transaction along with other assets.
  • Legal Requirements: We may share your Personal Information, including information about your interaction with our Services, with government authorities, industry peers, or other third parties (i) if required to do so by law or in the good faith belief that such action is necessary to comply with a legal obligation, (ii) to protect and defend our rights or property, (iii) if we determine, in our sole discretion, that there is a violation of our terms, policies, or the law; (iv) to detect or prevent fraud or other illegal activity; (v) to protect the safety, security, and integrity of our products, employees, or users, or the public, or (vi) to protect against legal liability.

4. Your rights

Depending on location, individuals across the globe may have certain statutory rights in relation to their Personal Information. For example, you may have the right to:

  • Access your Personal Information and information relating to how it is processed.
  • Delete your Personal Information from our records.
  • Rectify or update your Personal Information.

  • Withdraw your consent—where we rely on consent as the legal basis for processing at any time.
  • Object to how we process your Personal Information.

A note about accuracy: Services like Stylebuddy.in generate responses by reading a user’s request and, in response, predicting the words most likely to appear next. In some cases, the words most likely to appear next may not be the most factually accurate. For this reason, you should not rely on the factual accuracy of output from our models. If you notice that Stylebuddy output contains factually inaccurate information about you and you would like us to correct the inaccuracy, you may submit a correction request by contacting us. Given the technical complexity of how our models work, we may not be able to correct the inaccuracy in every instance. In that case, you may request that we remove your Personal Information from our platform.

We don’t “sell” Personal Information or “share” Personal Information for cross-contextual behavioral advertising (as those terms are defined under applicable local law). We also don’t process sensitive Personal Information for the purposes of inferring characteristics about a consumer.

Exercising Your Rights. To the extent applicable under local law, you can exercise privacy rights described in this section by contacting us.

5. Verification

In order to protect your Personal Information from unauthorized access, change, or deletion, we may require you to verify your credentials before you can submit a request to know, correct, or delete Personal Information. If you do not have an account with us, or if we suspect fraudulent or malicious activity, we may ask you to provide additional Personal Information and proof of residency for verification. If we cannot verify your identity, we will not be able to honor your request.

Authorized Agents. You may also submit a rights request through an authorized agent. If you do so, the agent must present signed written permission to act on your behalf and you may also be required to independently verify your identity and submit proof of your residency with us.

Appeals. Depending on where you live, you may have the right to appeal a decision we make relating to requests to exercise your rights under applicable local law.

6. Children

Our Service is not directed to children under the age of 13. Stylebuddy.in does not knowingly collect Personal Information from children under the age of 13. If you have reason to believe that a child under the age of 13 has provided Personal Information to OpenAI through the Service, please email us or contact us. We will investigate any notification and if appropriate, delete the Personal Information from our systems. If you are 13 or older, but under 18, you must have consent from your parent or guardian to use our Services.

7. Links to other websites

The Service may contain links to other websites not operated or controlled by us, including social media services (“Third Party Sites”). The information that you share with Third Party Sites will be governed by the specific privacy policies and terms of service of the Third Party Sites and not by this Privacy Policy. By providing these links we do not imply that we endorse or have reviewed these sites. Please contact the Third Party Sites directly for information on their privacy practices and policies.

8. Security and Retention

We implement commercially reasonable technical, administrative, and organizational measures to protect Personal Information both online and offline from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no Internet or email transmission is ever fully secure or error free. In particular, email sent to or from us may not be secure. Therefore, you should take special care in deciding what information you send to us via the Service or email. In addition, we are not responsible for circumvention of any privacy settings or security measures contained on the Service, or third-party websites.

We’ll retain your Personal Information for only as long as we need in order to provide our Service to you, or for other legitimate business purposes such as resolving disputes, safety and security reasons, or complying with our legal obligations. How long we retain Personal Information will depend on a number of factors, such as the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure, our purpose for processing the information, and any legal requirements.

8A. Security

We implement reasonable administrative, technical, and organizational measures to protect transaction data from unauthorized access, loss, or misuse.

9. International users

By using our Service, you understand and acknowledge that your Personal Information will be processed and stored in our facilities and servers in the United States and may be disclosed to our service providers and affiliates in other jurisdictions.

Legal Basis for Processing. Our legal bases for processing your Personal Information include:

  • Performance of a contract with you when we provide and maintain our Services. When we process Account Information, Content, and Technical Information solely to provide our Services to you, this information is necessary to be able to provide our Services. If you do not provide this information, we may not be able to provide our Services to you.
  • Our legitimate interests in protecting our Services from abuse, fraud, or security risks, or in developing, improving, or promoting our Services, including when we train our models. This may include the processing of Account Information, Content, Social Information, and Technical Information.
  • Your consent when we ask for your consent to process your Personal Information for a specific purpose that we communicate to you. You have the right to withdraw your consent at any time.
  • Compliance with our legal obligations when we use your Personal Information to comply with applicable law or when we protect our or our affiliates’, users’, or third parties’ rights, safety, and property.

Data Transfers. Where required, we will use appropriate safeguards for transferring Personal Information outside of the EEA, Switzerland, and the UK. We will only transfer Personal Information pursuant to a legally valid transfer mechanism. For more information on the appropriate safeguards in place and to obtain a copy of these safeguards, please contact us.

Account deletion

If you want to delete your data from our website in any way, follow the below steps:

  1. Visit the Contact us page on our website
  2. Fill your details in the form
  3. Share your email ID, country and full name in the form.
  4. Your request will be sent to us and we will delete the account details accordingly.

Changes to the privacy policy

We may update this Privacy Policy from time to time. When we do, we will post an updated version on this page, unless another type of notice is required by applicable law.

Pricing and Billing Errors

We reserve the right to correct any errors or mistakes in pricing, even if a transaction has already been requested or completed. In such cases, we may cancel or revoke affected Coins and issue a refund where appropriate.

12. Data Security

We implement technical and organizational measures in an effort to protect Personal Information from loss, theft, misuse and unauthorized access, disclosure, alteration and destruction, taking into account the nature of the Personal Information that we process, and risks associated with special categories of Personal Information we collect.
Specifically, We implemented the following measures to protect your Personal Information:

  • Encryption: We use an industry-standard security protocol (Secure Sockets Layer—SSL) to help ensure that the information is encrypted and protected from third parties. SSL helps ensure that the communication between your browser and our servers is private and that the information contained therein is safe and delivered only to our computers.
  • Firewall: Once your information reaches our servers, we protect it in many ways, including storing it on secure servers and using a device known as a firewall which protects your information by detecting and preventing unauthorized access to the information.
  • Authorized access: Using our firewalls and other mechanisms, we also protect your information by only allowing access to it by employees and authorized parties who have a legitimate and verified need to access the information in order to service your requests and administer policies and claims.

13. Face Data & User Image Usage

Certain features within the Stylebuddy application (including virtual try-on and image-based personalization) may require you to upload an image, including a photograph of yourself (“User Image”), in order to provide the requested output. For these features to work accurately, we may ask you to share an image that clearly shows your face and full body.

We respect user privacy and are committed to handling User Images in a secure and transparent manner. We do not directly capture, collect, store, or process facial identifiers ourselves. Any image analysis or transformation required for these features is performed via secure third-party APIs (including the Nano Banana API (a third-party image processing service provider)) strictly for the purpose of generating the requested result.

  • User Images are used only to provide the requested feature and output within the application.
  • We do not perform facial recognition for identification purposes.
  • We do not create, store, or retain facial identifiers such as facial templates, facial embeddings, or similar face-print data.
  • User Images are transmitted securely using encryption in transit (e.g., HTTPS/TLS) to third-party APIs for temporary processing.
  • We do not sell, rent, or share User Images for advertising or unrelated commercial purposes.

From a technical perspective, our application functions as an interface that securely transmits the User Image to processing APIs such as the Nano Banana API (a third-party image processing service provider). The processing is performed only to deliver app functionality, and we do not independently extract or store face biometric data on our servers.
